ARTICLE 1 — PARTIES

ARTICLE 2 — SUBJECT
The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, regarding the provision of the service purchased electronically by the BUYER from the SERVICE PROVIDER and the collection of its price.
ARTICLE 3 — NATURE AND PRICE OF THE SERVICE
The type, scope and price of the service are stated in the description and amount fields of the payment page provided to the BUYER. The stated price includes VAT.
Payment is made by credit or debit card with 3D Secure verification through the Kuveyt Türk Katılım Bankası A.Ş. Virtual POS infrastructure. The SERVICE PROVIDER does not store card details; they are transmitted to the bank only momentarily, for the purpose of carrying out the transaction.
ARTICLE 4 — PERFORMANCE OF THE SERVICE
The service is performed within the period and on the terms set out in the separate service agreement or accepted offer between the parties. Collection of payment is a precondition for performance of the service to begin.
ARTICLE 5 — RIGHT OF WITHDRAWAL
As a rule, the BUYER has the right to withdraw within 14 (fourteen) days in distance contracts for the provision of services.
However, under the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services whose performance has begun with the BUYER's consent. By completing the payment, the BUYER accepts that they request performance of the service to begin immediately and that they will therefore lose the right of withdrawal.
Where the right of withdrawal is available, notice must be given in writing to info@mindworks.media. Within 14 days of receipt of the notice, the total amount is refunded to the BUYER via the card used for payment. The time it takes for the refund to appear on the card account depends on the BUYER's bank.
ARTICLE 6 — RESOLUTION OF DISPUTES
For disputes, the Consumer Arbitration Committees at the BUYER's place of residence have jurisdiction within the monetary limits announced annually by the Ministry of Trade, and the Consumer Courts have jurisdiction for disputes above those limits.
ARTICLE 7 — ENTRY INTO FORCE
The agreement enters into force when the BUYER confirms electronically, at the payment step, that they have read and accepted it.

Ödeme sırasında beyan edilen ad/ünvan, e-posta adresi ve iletişim bilgileri esas alınır.
MADDE 2 — KONU
İşbu sözleşmenin konusu, ALICI'nın HİZMET SAĞLAYICI'dan elektronik ortamda satın aldığı, aşağıda nitelikleri ve bedeli belirtilen hizmetin sunulması ile bedelinin tahsiline ilişkin olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerinin belirlenmesidir.
MADDE 3 — HİZMETİN NİTELİĞİ VE BEDELİ
Hizmetin türü, kapsamı ve bedeli, ALICI'ya iletilen ödeme bağlantısındaki açıklama ve tutar alanlarında belirtilmiştir. Belirtilen bedel KDV dahildir.
Ödeme, Kuveyt Türk Katılım Bankası A.Ş. Sanal POS altyapısı üzerinden, 3D Secure doğrulaması ile kredi kartı veya banka kartı kullanılarak yapılır. HİZMET SAĞLAYICI kart bilgilerini saklamaz; bu bilgiler yalnızca işlemin gerçekleştirilmesi amacıyla anlık olarak bankaya iletilir.
MADDE 4 — HİZMETİN İFASI
Hizmet, taraflar arasında ayrıca akdedilen hizmet sözleşmesi veya kabul edilen teklif kapsamında belirlenen süre ve şartlarda ifa edilir. Ödemenin tahsil edilmesi, hizmetin ifasına başlanması için ön şarttır.
MADDE 5 — CAYMA HAKKI
ALICI, hizmet ifasına ilişkin mesafeli sözleşmelerde kural olarak 14 (on dört) gün içinde cayma hakkına sahiptir.
Ancak Mesafeli Sözleşmeler Yönetmeliği uyarınca, ALICI'nın onayı ile ifasına başlanan hizmetlerde cayma hakkı kullanılamaz. ALICI, ödemeyi tamamlamakla hizmetin ifasına derhal başlanmasını talep ettiğini ve bu durumda cayma hakkını kaybedeceğini kabul eder.
Cayma hakkının kullanılabildiği hâllerde bildirim, info@mindworks.media adresine yazılı olarak yapılır. Bildirimin ulaşmasından itibaren 14 gün içinde toplam bedel, ALICI'ya ödemede kullandığı kart üzerinden iade edilir. İadenin kart hesabına yansıma süresi ALICI'nın bankasına bağlıdır.
MADDE 6 — UYUŞMAZLIKLARIN ÇÖZÜMÜ
Uyuşmazlıklarda, Ticaret Bakanlığı'nca her yıl ilan edilen parasal sınırlar dâhilinde ALICI'nın yerleşim yerindeki Tüketici Hakem Heyetleri, bu sınırların üzerindeki uyuşmazlıklarda ise Tüketici Mahkemeleri yetkilidir.
MADDE 7 — YÜRÜRLÜK
ALICI, ödeme adımında işbu sözleşmeyi okuduğunu ve kabul ettiğini elektronik ortamda onaylamakla sözleşme yürürlüğe girer.
